Abstract

In every commercial transaction, it is fundamental to determine the degree of responsibility of the involved parties. In ancient Rome this was definitely legislated at the end of the Republic in order to establish repair of damages caused to the buyer due to the so-called "latent defects" and "hidden vices" that could eventually appear in slaves and animals subject to purchase and sale. This article refers to the aedilitian edict wich legislated about his matter, as well as to the jurists' commentaries that can be found in the Digest.
